TERMS AND CONDITIONS

Use of Minnesota MicroNet constitutes acceptance of these
Terms and Conditions, and its acceptable use policy. You also agree
to abide by the acceptable use policies of the networks you access
through Minnesota MicroNet. Acceptable use on the Minnesota MicroNet
system prohibits, but isn't limited to, unsolicited advertising,
transmission of any material in violation of any U.S. or state
regulation, copyrighted material, threatening or obscene material,
material protected by trade secret, transmissions of any type or
quantity that cause disruption of services to others, use of the
network to make unauthorized entry to other computational,
information or communications devices or resources, or propagation of
computer viruses or worms.

Minnesota MicroNet may only be used for lawful purposes. If you use
its service for something other than lawful purposes, you agree to
indemnify and hold Minnesota MicroNet harmless from any claims or
damages by you or another party which result directly or indirectly
from unlawful use.

Minnesota MicroNet strives to provide the best possible service, but
makes no warranties of any kind, whether expressed or implied, for
the service it provides. This includes loss of data resulting from
delays, nondeliveries, misdeliveries, or service interruptions caused
by its own negligence or your errors or omissions.

Minnesota MicroNet does not normally examine messages or files
residing on or passing through its computer system, and exercises no
control whatsoever over the content of the information residing on
or passing through it. Minnesota MicroNet specifically denies any
responsibility for the accuracy or quality of information obtained
through its services. Use of any information obtained via
Minnesota MicroNet is at your own risk.

Minnesota MicroNet may occasionally require new registration and
subscription information from you to continue your service. Should
this become necessary, you will be notified. If changes to your
subscription information occur on your end, you agree to notify
Minnesota MicroNet so that its information is current and accurate.

Account holders certify that they are at least eighteen (18) years
of age or older. You agree to the rates and billing procedures
presented in the current version of rates and services. Minnesota
MicroNet reserves the right to change the rates and otherwise modify
this agreement upon thirty (30) days notice to you. Use of Minnesota
MicroNet after the effective date constitutes acceptance of the new
Terms and Conditions.

Upon written notification, you have the right to terminate your
subscription at any time, for any reason. Minnesota MicroNet also
has the right to terminate your subscription at its discretion, for
reasons including, but not limited to, violating its Terms and
Conditions and/or its acceptable use policy, untimely payment or
non-payment of charges for service fees and surcharges, repeated
incidents of complaints from other network users which Minnesota
MicroNet determines to be valid, or inappropriate usage determined
by Minnesota MicroNet or other relevant authorities. If your
subscription is terminated, you will be refunded the unused portion
of your service fees, less any unpaid balances owed to Minnesota
MicroNet.

These Terms and Conditions reflect the entire agreement between you,
the subscriber, and Minnesota MicroNet, and supersede all prior oral
or written agreements and understandings between the subscriber and
Minnesota MicroNet. These Terms and Conditions shall be governed
and interpreted in accordance with the laws of the State of
Minnesota, United States of America.
